英文摘要	李样举，中国人民大学法学院博士研究生; 韩大元，中国人民大学法学院教授、博士生导师。; 【中文摘要】在我国，法律与宪法规范表述趋同化现象比较普遍，这与沿用多年的“宜粗不宜细”的立法技术不无关系。其结果，将会模糊宪法与法律之间的功能界限，不利于宪法实施；构成立法不作为，虚置了宪法委托，不利于权利保障，影响公权力运行。增强立法的具体化功能成为解决这一问题的不二之选，而我国台湾地区的经验值得借鉴。当下我国立法具体化限度的保持应从以下几 方面进行：首先，在立法过程中强化法律保留原则对立法权的控制以限制不必要的立法授权;其次，构建法的明确性原则的层级体系，优化法律规范的表述；再次，在法律施行过程中加强立法评估并及时进行监督。 【Abstract】It is commonplace to find convergence in the statements concerning norms between Chinese legislation and China's Constitution. This phenomenon can be explained by the legislative technique of "general rather than specific" which has been used for many years in China. Consequently，it is detrimental to the implementation of the Constitution，as it blurs the boundaries between the Constitution and legislation; it leads to legislative inaction and disregard of constitutional entrustment; it is not conducive to the guarantee of rights thereby hindering the exercise of public power. Therefore，to strengthen the reification of the legislation is the best approach to solving this problem，and it is worthwhile to draw upon Taiwan's experience. It is argued that current reifications of Chinese legislation must keep in line with the following rules. Firstly，enhance the control of the principle of legislative reservation over legislative power to avoid unnecessary legislative authorization during the legislation process. Secondly，establish a hierarchy of the principles of legislative explicitness to optimize legislative norms. Finally，strengthen the mechanism for legislative assessment and conduct timely supervisions during the implementation of law.; 国家社科基金重点项目“完善和发展中国特色社会主义法律体系的理论与实践问题研究” (11AFX001)
