| 英文摘要 | 网页快照服务是搜索引擎通过机器人程序抓取网页并储存在自己的服务器中，待用户进行搜索时向用户提供的网络技术。按照传统的侵权构成四要件进行分析，网页快照服务既是复制行为也是信息网络传播行为，通常会造成著作权人利益受损，该服务也是出于搜索引擎的故意，如果网页快照服务与损害结果也存在着因果关系，那么网页快照服务就构成侵权。 搜索引擎是否需要承担侵权责任，还要考虑抗辩事由。抗辩事由主要包括合理使用、系统缓存避风港和默示许可。采用灵活的开放式立法模式的合理使用制度可以作为网页快照服务侵权的抗辩事由。系统缓存避风港不能成为网页快照服务侵权的抗辩事由，因为系统缓存与网页快照的技术原理并不相同。默示许可因为不...; Web caching service is a kind of network technology that search engines crawls web pages by using robots, store the information in their server and provide to users when users search for something.
