| 英文摘要 | “PatentPool”作为专利集中的一种协议安排，最早在美国出现，至今已经有150年左右的历史了；而在中国，专利池仅仅是在最近几年才引起实务界和学术界的关注。专利池的特点在于将专利权进行集中并进行统一授权，它与垄断存在紧密的联系，因此专利池的反垄断规制必然成为理论研究的重点。然而，由于专利池在我国仅仅在最近几年才引起学者们的关注，因此，目前我国学术界关于专利池反垄断规制的研究成果尚不充足。本文试图从理论上探讨对专利池的非法垄断行为进行反垄断规制，并为完善我国目前专利池反垄断规制的法律体制提供建议。 除引言和结论外，全文分为三章。 第一章是“专利池及其可能引起的竞争问题”。对专利池的组建及...; patent pool is made up of a set of patent-licensing agreements, which came out in the United States firstly and with a history of about 150 years, relatively, it got attention from academic circles and practical fields just few years ago in China.
