英文摘要	商标标识功能是商标的原始功能，也是其基本功能，在商标法律制度中占据着极其重要的地位。商标标识功能之所至，商标生命之所在。商标标识功能是商标赖以存在的基础，商标侵权归根结底是对商标标识功能的损害。因此，对商标的侵害达到足以损害商标标识功能的程度，均应当直接认定为商标侵权行为。理论上的探讨被司法实践所证实，如浙江高院审理的“蓝色风暴”案、欧盟法院审理的Arsenal标识案、Opel汽车模型案，这些案件直接适用商标标识功能作为侵权认定标准。那么，商标标识功能作为侵权认定标准有什么理论基础呢？其属性如何？其具体适用规则又是怎样的呢？该标准与混淆可能性标准和反淡化标准存在怎样的关系呢？本文将分四章针对以...; The identification function of trademark is not only the original function but also the basic function, occupying an important position in the trademark law.
