| 英文摘要 | 知识产权是把双刃剑，它既能激励创新，亦可能导致权利滥用而为限制自由竞争提供滋生的土壤。制药行业对于知识产权具有高度依赖性。专利药企业若滥用其专利权将不利于医药行业的健康发展，更会推迟公众购买低廉的仿制药的时间，影响到社会公共健康福利。反向支付是美国医药专利诉讼中的一种常见行为。通过反向支付协议，专利药企业能够很好地实现其延迟仿制药上市的目的，为其带来巨额垄断利润。近期，大量药品专利的专利权将期限届满，为维持巨额垄断利润，专利药企业会通过各种方式延迟仿制药的上市时间，而反向支付是最有效的推迟方式，所以反向支付协议在我国出现不可避免。反向支付协议的目的、内容及形式不同，会导致不同的竞争效果。美国适...; Intellectual property is a double edged sword, which can stimulate innovation.
