| 英文摘要 | 本文意识到文本的生产过程中融入了多种复杂的社会因素，力求从不同种类的文本入手，有限度地探讨各种文本资料（地方志、治闽政书、民间诉讼录、判牍、档案）所能揭示的法律、社会历史内容，希望能一窥清代福建省丰富的法律生活场景，并进而揭示清代福建府县司法运作的实态，及其各种影响因素。 方志作为地方文化知识的基本工具书，多从正面阐述地方历史文化资源为主，但福建省很多方志却众口一词地论述当地“健讼”或“既健讼又寡讼”。“健讼”概念的文本分析，发现方志作者的“健讼”批判多充满了主观色彩，既没有经过实地调查，也误解了健讼的含义，“健讼”的道德批判多于法律评价。在分析地方志记载纠纷类型基础上，文章通过实证研究，认...; This article, realizing that the process of the textual production involves a variety of complex social factors, analyzes the legal, social and historical content in different texts (such as local chronicles, administrative books, folk lawsuit records, pan du(判牍), and archives in Fujian province, China).
