| 英文摘要 | 随着海洋经济的快速发展，我国海洋生态损害也日趋严重。近海海域赤潮频发，石油泄漏事件不断，再一次敲响了人类可持续发展的警钟，如何救济这类损害是我们必须要解决的问题。生态损害，不同于传统意义上以环境为“媒介”的人身损害、财产损害或精神损害，而是对生态环境“本身”的损害。环境损害作为一种新型的损害，目前在国内很少有人探讨，而且在我国的法律制度和司法实践中，各种损害赔偿只涉及对具有经济价值的损失的弥补，却忽视对海洋生态环境本身的生态利益保护。因此有必要以这种新型的损害为研究对象，探讨如何通过法律手段有效地救济海洋生态损害。 本文从我国海洋生态系统面临的生态损害现状出发，通过对生态损害的概念剖析入手，...; With the rapid development of marine economy, a growing number of marine ecological damages in China are becoming more and more serious.
