| 英文摘要 | 审判独立是司法公正、人权保护和法治国家建设不可或缺的制度构件。党的十八届三中全会和四中全会的司法改革蓝图，彰显了领导人对法治和审判独立价值的高度认同，然而此前的历次司法改革，都难以触及推动审判独立的实质性改革。不仅如此，在当下中国不论是官方、学界还是公众，有关审判独立改革的观念意识形态也远未达成共识。长期以来形成的观念意识形态迷思不可能一朝消失，突破各种正式和非正式的制度障碍也非一日之功。在重启审判独立改革之时，我们必须回答如下问题：审判独立的意义何在？审判独立是否与有中国特色社会主义的政治制度相容？当前中国推进审判独立改革的必要性和可行性能否得到证成？推动改革可持续的政治动力如何获得？阻碍改...; “Judicial independence” is the essential institution to ensure judicial justice, human rights protection and rule of law.
