英文摘要	发展海洋经济需要占用大量渔业海域，这对沿海渔民的经济利益和生产生活造成了一定冲击。在发展海洋经济过程中，政府应当如何应对并妥善解决渔业海域的收回和补偿问题，已经成为保障渔民合法权益和生存发展的一项迫切要求。 本论文研究的开展是基于法学和经济学等基础理论，采用规范分析与实证分析相结合的方法，在明晰“渔业海域”、“海岸线”、“滩涂”、“潮间带”、“收回”及“占用”内涵的基础上，首先，从渔业海域产权体系分析渔业海域使用权与公共利益之间的关系、与公权力之间的关系，进而对渔业海域收回补偿的产权价值进行分析。然后，进行渔业海域收回公平补偿的程序公正分析，阐述渔业海域收回的性质与程序、渔业海域收回的利益相...; The development of marine economy requires a large number of fishing areas, which has a certain impact on the economic interests of the coastal fishermen and the production and life.
