| 英文摘要 | 我国法律没有明确法官享有豁免权，然而法官豁免制度的建立是保证司法独立和法官心证自由的前提，意义重大。从现实角度出发，法官豁免制度的建立将直接推动刑事错案纠错的顺利开展；从司法改革角度出发，确立法官豁免权是从源头上保证案件裁判公正，防止刑事错案发生的重要举措。 在推进司法改革的大背景下，本文以刑事错案纠错为切入点，在借鉴国外司法豁免权的基础上，尝试探讨在立法上确立法官豁免权，在实践中完善豁免法官的程序，从而建立起以正当程序为基础的法官豁免权。 本文除引言和结语外，共分为四章。 第一章法官豁免和刑事错案纠错的关系。本章以刑事错案纠错为切入点，讨论法官在刑事错案生成和纠错中所扮演的角色，从而引...; In China, law does not stipulate judicial exemption.
