| 英文摘要 | 有着“公序良俗第一案”之称的“泸州遗赠案”，在实务界和学术界乃至社会上引起了讨论遗嘱自由与公序良俗之间关系的轩然大波。与此类似的案例有“益阳遗赠案”与“芷江遗赠案”。将遗产赠与第三者（或者反过来）是否违背公序良俗？遗嘱自由与公序良俗孰轻孰重？公序良俗对遗嘱自由的限制应当具备什么条件？这些问题亟需得到学术界和实务界达成一致。通过对“泸州遗赠案”的评论和分析，本文尝试着回答上述三个问题，并由此将论文分为三个部分： 第一章，遗嘱自由和公序良俗。结合具有代表性和典型意义的实证案例，阐述遗嘱自由和公序良俗的概念、特征和价值，论述当二者发生冲突时，在干涉婚姻自由等七种极端情形之外，遗嘱自由应当优先于公序...; Known as "the first case of public order and good custom", "Luzhou legacy case" kicked off a firestorm on the relationship between the freedom of Testament and public order and good customs in practical circles, academic circles and even the whole society.
