| 英文摘要 | 刑罚变更执行是刑事诉讼的最后一道关口，目前我国的刑罚变更执行程序将受害人被排除在外，不仅与其当事人地位不符，也导致其缺乏保障实体利益的有效手段。保障受害人在刑罚变更执行中的合法权益，赋予其诉讼参与权，既是刑事诉讼程序正当化的要求，也有利于刑罚功能的实现。 本文主要分为以下几个部分： 第一章对受害人权益等基本概念进行简要说明，指出刑罚变更执行阶段受害人的诉讼地位已经发生变化，其权益本质要求不仅仅在于惩罚加害人，还在于其实体利益的实现，为展开全文做了铺垫。 第二章从程序参与和实体利益两个方面，指出我国刑罚变更执行阶段受害人权益保障的困境，分析问题产生的原因在于国家掌握了排他性的惩罚罪犯的权力...; Currently, the phenomenon is widespread that the right of victims cannot be guaranteed during the criminal enforcement in China, which not only damages the judicial credibility, but also leads to the destabilizing factors of society.
