| 英文摘要 | 我国民事诉讼制度的特色之一，是立案审查制度和法院内立案机构的设立。近年来，我国司法制度不断完善，与此同时，立案审查制度的缺陷也愈发突显，“立案难”现象经常见诸报端。实务界尝试改进立案工作方法，学术界则提出了用立案登记制替代立案审查制的改革建议，引起各方争论。《中共中央关于全面推进依法治国若干重大问题的决定》的出台及《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》的规定，明确了由立案审查制向立案登记制转变。因此，如何从实践出发，结合学理研究，探求在当前司法环境下立案登记制度的构建显得尤为必要。本文从比较法角度入手，对当前时期我国民事诉讼立案登记制度的内涵、实质进行重新审视，深入分析该制...; One of the characteristics of civil procedures system lies in the establishment of the filing review system and the court filing agency.
