| 英文摘要 | 近年来，我国社会治理呈现“新常态”，社会不稳定因素持续增多，社会维稳压力持续增大，伴随而来的是新矛盾、新问题、新风险的产生。在新常态的社会治理背景下，我国监狱刑罚执行在取得丰硕成果的同时，也面临着日益显现的困境。当前，押犯爆满、执法威慑力下降、执法公信力受到挑战，以及罪犯思想改造形势严峻、罪犯日常管理难度提高、制约罪犯手段有限、监狱民警工作压力大等成为困扰监狱刑罚执行的主要问题。本文认为要系统解决社会治理新常态下监狱刑罚执行的困境，应在法律、政策、相关机制以及具体执行上寻求突破：一是通过刑事法律的完善、大力保障监狱民警的执法权、依法打击狱内违规抗改、违法犯罪行为，全面提升监狱刑罚执行的威慑力；...; In recent years, China's social governance is a "new situation ".It is difficult to maintain social stability.More and more unstable factors appear.
