英文摘要	20世纪90年代以来，美国联邦最高法院和下级法院针对“数据”作出的一系列判决，无论是对第一修正案覆盖的言论还是对现代数据的保护，都达到了前所未有的高度，成为大规模计算机时代的讨论焦点。本文主要以美国联邦最高法院和下级法院将“数据作为（视为）言论”的案件为线索，讨论美国司法界对数据保护之态度，并尝试对数据所具有的言论属性，以及在数据分析势头下，数据自由与政府管制利益的论争作出解释，以期为中国数据保护的理论和实践提供些许智识支持。 导言部分阐述了讨论数据的第一修正案保护问题的缘由。近期，美国联邦最高法院和下级法院将第一修正案的言论保护范畴延伸至数据的做法，对政府数据管制提出了新挑战。较之中国数据...; Since the 1990 s, the U.S. Supreme Court and lower courts have made a series of critical decisions about the legal protection of data, which lead to an unprecedented level of modern data protection, as well as speech under the First Amendment of Constitution.
