英文摘要	节能法律的制定就是为了维护具有稀缺性的能源资源的合理利用，因为能源资源是稀缺的，每个人都拥有对于能源资源的平等的使用权，当某一部分人大量的使用稀缺的能源资源，并造成严重浪费时，就是对能源使用的平等性和稀缺性的破坏，为了保障能源资源的合理开发和可持续利用，应该制定法律对此行为进行约束，体现资源的稀缺性。 《中华人民共和国节约能源法》的条款中没有提到如何淘汰落后的高耗能产品、设备和生产工艺，以至于后来国家出台的政策也没有实际的可操作的执行程序，这会造成淘汰落后的高耗能产品、设备和生产工艺的法律法规在执行过程中遇到困难和阻碍，甚至导致法律法规的无法落实。 论文包括引言、正文、结语等三大部分，其中...; The law of energy conservation is to protect the equality of energy resource, because energy resources are scarce, everyone has the equal right to the use of energy resources, when somebody use a large number of energy resources, and causing serious waste, is equal to the destruction of the equality of energy resource.
