| 英文摘要 | 内容摘要 废除死刑已经成为国际社会的主要共识，我国作为在国际上发挥着举足轻重作用的国家，也是联合国五个常任理事国之一，为在国际上扮演更重要的角色，有必要正视我国的死刑制度，着手研究我国死刑的废除问题。 本文在结构上分为引言、正文、结论三部分。正文共分五章。 第一章介绍死刑的概念、死刑制度的法律规定、中国古代的死刑制度、中国民国时期和解放以后的死刑制度、现在的死刑制度，意在使对我国死刑制度的发展进程有一个初步的了解。 第二章从比较法视角看死刑制度。首先介绍死刑废除理念的源起以及最早一些国家的死刑废除实践。接着对英国、美国、日本、印度、韩国等死刑制度进行了概括和比较，最后总结出废除死刑的国...; ABSTRACT Abolish the death penalty has become the main consensus of the international community.
