| 英文摘要 | 辨认一直是侦查机关广泛采用的侦查措施，但是因错误辨认而导致的冤假错案却频繁发生。在“问题主义”精神的指导下，本文的行文思路是，以实证研究的方法发现问题，再探讨问题背后的原因，最后提出问题的解决方案。 本论文通过分析我国80年代以来的17起错案来寻找错误辨认的类型并剖析其原因，进而提出完善现有刑事辨认规则的建议。论文第一部分研究了我国现存的错误辨认，笔者将其归纳为三大类：第一类，违反辨认规则的程序性错误，如发生频率最高的是违反事先询问规则，其次是违反混杂辨认规则，禁止暗示规则，可以说公安机关几乎无视现有的辨认规则；第二类，则是辨认者辨认错误，本文主要指辨认者对高度腐烂的尸体辨认错误；第三类，警...; Identifying has been widely used by the investigation organ as an investigation measure.
