| 英文摘要 | 股票发行注册制改革正紧锣密鼓地筹备着，证券市场市场化势在必行，而证监会监管权是证券市场市场化的关键。在我国证券市场“新兴+转轨”的特点下，证监会监管权还有诸多不符合市场化的地方。因而，对当前市场化下证监会的监管权进行分析，探讨其现状以及找出其革新路径很有必要。 第一章介绍证监会监管权的基础问题。首先界定证监会监管权，指出其包含的权力内容以及不同类型监管权及其优缺点。其次介绍自由市场与政府监管的理论以及证监会监管权与市场秩序、安全和效率的价值理念，为后文论述提供理论基础。 第二章分析当前证监会监管权的现状和问题。首先我国证监会初步拥有规则制定权、行政审批权、监督检查权以及违规处罚权四大权力，...; Stock issuance registration system reform is in full swing preparing, and securities market’s marketization is imperative.
