| 英文摘要 | 伴随着我国经济的飞速发展，家庭拥有轿车的数量也与日俱增，其结果就是对停车位、停车库的需求也随之猛增。对于商品房小区停车位应归谁所有、谁有权进行处置，已实际成为一个重大的民生问题。而随着《中华人民共和国物权法》的颁布实施，其中第七十四条对停车位、停车库的归属进行了规范。但是，《物权法》的该条规定过于原则，在实践中的具体操作仍有较大争议。此后最高人民法院又作出《关于审理建筑物区分所有权纠纷案件具体应用法律若干问题的解释》，其中第五条和第六条对物权法第七十四条作出了相应解释。结合《物权法》和司法解释的规定，可以看出当前我国立法界对停车位、停车库的归属采取的是约定归属说。这种立法理念有其合理性，但在实...; With the rapid development of economy in our country, the number of family owned cars also grow with each passing day.
