| 英文摘要 | 对于非法证据排除的研究，已经有非常多的研究和探讨。但现实是，非法证据排除规则在我国的实质成果事实上是很有限的，这并不是说过往的研究没有切中症结及问题的要害，而毋宁说非法证据排除的展开在我国遇到了一些学术研讨，以至司法机关本身所无法克服的一些短期障碍。正是基于这样的考量，在本文，笔者拟结合自己作为一名检察机关办案人员的工作经验，结合自己收集到的一些案例素材，从一个侧面——检察机关审前审查判断非法证据的角度来展现司法实务的现实状况和进展。 论文除引言和余论之外，共分三章。第一章是有关立法规定及检察机关在排除非法证据上的作用、价值和意义。第二章涉及到的实务中对非法证据的界定以及排除非法证据的标准。...; The thesis focused on a richly researched China criminal procdural law and evidence law issue, exclusionary rule, now maily on account of on my personal work experience as a procurator.
