英文摘要	国民待遇标准是国际投资领域最为重要的法律问题之一，在理论和实践中争议颇多。国民待遇不仅关系到外国投资者和投资的权益，也关系到东道国和投资母国的国家主权与安全，是各方利益相互角逐的焦点。本文拟从实证角度出发，以国际投资仲裁为视角，首先简要介绍国际投资条约中的国民待遇；其次分析仲裁庭在认定国民待遇过程中出现的主要问题，以便更全面地认识国民待遇；最后考察中国投资条约中有关国民待遇的缔约实践，指出其问题所在，并结合有关国民待遇的仲裁实践，为中国完善投资条约中的国民待遇条款以及参与国际投资仲裁实践提供建议。; National treatment standard, which bears lots of controversies both in theory and practice, is one of the most important legal issues in the international investment field.
