英文摘要	世界贸易组织（WTO）的首要目标是促进国际贸易的公平和自由。但是，非法补贴妨碍了这一目标的实现，成为一国进行贸易保护的工具，因为补贴往往向补贴接受者授予一项好处。WTO框架下，无论是对禁止性补贴、可诉性补贴提出申诉，还是实行反补贴措施，首先要证明补贴的存在。根据《SCM协定》第1.1条的规定可知，是否“授予一项利益”是认定补贴的关键，同时“利益”也是计算反补贴税的重要基础，可见，“利益”的认定是构成“补贴”并适用补贴多边纪律的前提。然而，《SCM协定》中并没有就“授予一项利益”进行明确，WTO虽然经过多年实践运作，但相关的法律适用和解释仍然存在歧义和含混，使得WTO中涉及补贴的纠纷争议不断。在...; The primary target of WTO is to promote the fairness and freedom of international trade.
