| 英文摘要 | 在由缺陷产品引发的事故中，追求生产企业的刑事责任主要围绕两个阶段来进行。一是在产品开发与制造阶段，由于对从业人员的监督、设备的管理不当等原因，而使产品产生了某种缺陷，导致事故发生；二是在回收阶段，没有恰当的对缺陷产品进行回收，而导致被害扩大的场合，企业应承担因不作为的刑事责任。 在第一阶段中主要存在的问题是在不存在故意的场合，如何追究企业上层管理人员的过失责任。围绕该问题，日本司法中主要通过监督过失理论来认定其刑事责任。我国学者也对该理论深入的学习和研究，并在火灾事故、交通事故中有所应用。但是该理论并没有在我国产品刑事责任领域得到很好的适用，其主要的原因在于对预见可能性的判定上，因此本文拟通...; In the accidents due to defective products, there are two stages to pursue the criminal responsibility of manufacturers.
