英文摘要	“投资者”认定在国际投资仲裁实践中有非常重要的作用，因为不同于着力于保护人权等公共价值的国际公约，投资条约只保护各自的合格投资者，只有合格的投资者才能获得条约保护，才能享有将投资争端诉诸国际仲裁庭解决的资格。法人（公司）是进行国际投资的主要主体，法人的投资者身份判断是投资者认定的主要内容，也是难点和争议所在。一方面，法人的国籍是判断法人投资者身份的主要依据，但国际法和实践都没有形成判断法人国籍的统一标准。另一方面，经济全球化下的法人的自身特点，给投资者认定带来了新的挑战。 本文除引言外，主体部分包括四章： 第一章主要内容分为两节：第一节部分是对国际投资争端仲裁的概念、产生背景和当今实践情况...; The identification of ‘investor’ is meaningful in international investment arbitration.
