| 英文摘要 | 为避免“公地悲剧”的出现，国际社会达成建立气候国际法律制度的共识。然而这一制度本身就是全球性的公共物品，“搭便车”问题加之各国为最大化争夺“气候环境容量”展开的激烈博弈，导致气候治理进程发展阻滞、绩效平平。究其根源在于气候问题的本质是经济与发展问题——气候问题从其产生、影响到解决策略都与世界经济一体化进程具有不可分割的联系。国际制度互动理论为解决因气候与贸易议题交叉而导致的“条约拥塞”问题提供了新思路，制度决策者们应该加强作为气候与贸易问题的治理资源即气候与贸易国际法律制度之间的正面互动，以促进气候治理与自由贸易发展并行不悖。绿色贸易是低碳经济的重要组成部分，而发展低碳经济则是应对气候变化的主...; To avoid the emergence of the "tragedy of the Commons", the international community has established the international legal system of climate.
