| 英文摘要 | 从上个世纪60年代开始，经济分析法学逐渐在西方国家之中蔚然兴起。随着刑事诉讼法律改革和发展的不断深入，西方经济分析法学的理念也引发我国学者的重视和思考，并被逐渐引入到法律程序的运用当中，即所谓的法律程序中的经济效率问题。诉讼程序的效率问题，逐渐通过将程序进一步简化来解决。因此，刑事简易程序逐渐成为经济分析法学发展的一种代表制度。我国《中华人民共和国刑事诉讼法》（以下均简称为《刑事诉讼法》）一直没有设置刑事简易程序，虽然有各种探索性的做法，但是直到1996年修订诉讼法的时候才正式增设了简易程序。众所周知，刑事普通程序办案较慢，容易衍生出诉讼迟延、案件累积等问题，导致诉讼效率比较差，并因此给整个司...; Since the 1960s, the economic analysis of law in the western countries become gradually arisen.
