| 英文摘要 | 刑事辨认作为一种侦查措施在锁定犯罪嫌疑人、获取犯罪证据等方面具有不可忽视的重要作用。2012年新《刑事诉讼法》明确辨认笔录为法定的证据类型，与勘验、检查笔录并列成一种独立的证据种类，这使得辨认笔录在诉讼中具备合法性，结束了司法界、学术界多年来的争议。但刑事辨认在实际的操作中还存在很多的难点与问题，不科学地运用辨认会给刑事诉讼带来较高的风险，采信错误的辨认结果有可能导致错案的发生。本文对侦查过程中刑事辨认的运用与错误的原因进行了详细分析,同时考察了刑事辨认制度先进国家行之有效的经验，以期对我国刑事辨认制度的发展及完善有所裨益。全文由四部分组成,主要内容如下: 第一章，刑事辨认的概述。本章首先梳...; As a kind of investigation measures, criminal identification plays an important role in determining the criminal suspect and obtaining criminal evidence.
