| 英文摘要 | 我国立法对于非婚同居财产归属问题的规定非常滞后，导致法官对于同居析产纠纷的裁判标准不一，这对于本就维权不易的非婚同居当事人来说，无疑是雪上加霜。笔者从法律文书库中抽取30个样本，对裁判结果进行分析，探究法官审理同居析产纠纷的法律观点。提出我国立法应符合社会发展规律，在肯定婚姻主导地位的同时，将非婚同居问题纳入家庭法的规制范畴，引导人们根据实际情况选择自己的生活方式，并探寻在有关立法尚未完善的情况下，如何统一同居析产纠纷的裁判尺度问题。 除引言与结论外，本文分为三章： 第一章为非婚同居财产归属问题概述。本章对非婚同居的概念进行界定，分析其与相似概念的区别。因非婚同居双方当事人具有特殊亲密关系...; Based on the fact that the Chinese legislation doesnot pay enough attention to the Non-marriage Cohabitation, and the current legislatae situation leads to a result of “open dialogue” in the juridical practice, judges hold different views and opinions from each other, it definitely rub salt into the litigant’s wounds.
