| 英文摘要 | “立法”是人类一项危险的发明，它赋予人类自我支配力量的同时，隐藏着被滥用而造成毁灭性恶果的风险。近年来法理学研究有转向实证研究的潮流，对文本的用字、术语、层次、结构予以解构分析。从实证角度看，“但书条款”遍布我国每一部法律文本，学界却未对其进行系统性研究。本文将以语义分析和实证分析为主要研究方法，通过对但书条款在文本中的意涵、搭配和分布进行分析，厘清但书条款之概念，及其在语言系统、法律体系中的价值。 本文主体框架分为三个部份。 第一部份将但书条款置于语言系统中考查，通过但书条款常用标记词字源、词性和功能的考察，得出但书条款适用标记词最优方案之规律。本文认为，文本对语言符号的选用具有一定的随...; “Legislation” is a dangerous human invention, it gives human the power to dominate our own destiny.
