英文摘要	民主原则是我国立法的基本原则之一，就民主原则在立法过程中发挥作用的方式来看，可以将立法过程分为个体意志的表达和个体意志形成公意的两个阶段。但在立法实践中，民主原则在这两阶段发挥作用的方式和机制都面临着困境，这些困境归根到底是源于群体中个体意志的分歧以及对分歧的判断和选择。本文试图借用社会选择理论的部分理论工具，对立法民主原则所面临的这两个困境的原因进行一些分析和探究，并就可能的解决路径提出一些思考。 本文首先对立法过程中的分歧和民主原则对分歧的应对机制进行概括，分析分歧的类别、根源以及在立法过程中的表现形式，明确立法民主原则在解决分歧上发挥作用的两个阶段：个体意志的表达阶段和个体意志形成公意...; The principle of democracy is one of the basic principles in legislation in china, legislative process can be divided into two stages based on the ways principle of democracy works: the expression of individual will and the general will generate from individual will.
