| 英文摘要 | 根据我国刑法规定，教唆、帮助自害行为并不是犯罪，但是教唆、帮助自害行为本身具有的社会危害性以及行为方式的特殊性使得此行为成为了一个在刑法领域中值得研究的问题。本文根据教唆、帮助自害行为的特点以及我国现行刑法规定，对该行为进行讨论分析。 第一章从自害行为和教唆、帮助自害行为的性质入手，分别阐释二者的特征；接下来，对教唆自害行为和帮助自害行为分别讨论，第二章以共同犯罪基本理论为切入点，结合我国的刑法规定，讨论共犯理论对教唆、帮助自害行为的适用问题。第三章对于根据教唆对象的不同，将教唆自害行为分为教唆无民事行为能力、限制行为能力人和完全民事行为能力人两类，并从行为性质、教唆者主观方面、教唆对象等几...; According to the rules of criminal law in our country, the behavior of instigating or helping suicide and self-inflicted don’t belong to crime.
