英文摘要	随着知识经济的到来，专利权作为一种无形资产，在资本市场中的地位越来越突出。然而，专利成果转化难一直是制约我国专利事业快速发展的瓶颈，从而直接影响了我国知识经济的快速发展。同时，专利成果转化难在相当程度上也是世界性难题。围绕着突破这个难题，多年来广大学者从不同渠道、不同路径进行了探索，专利信托就是在这种背景下应运而生的。因此，本文以运用信托手段管理专利权为主要论点，分别采用历史分析、实例考察和价值分析的研究方法，从信托制度的基础理论入手，在对比分析日本成功的专利信托实例和我国失败的专利信托实例的基础上，深入探究了我国专利信托实践失败的原因，进而对我国专利信托的制度构建提出相应的完善建议。 全文...; With the coming of the knowledge economy, patent as a kind of intangible property, plays more and more important role in the capital market.
