| 英文摘要 | 服务期是用人单位和劳动者在劳动合同之外通过平等协商而达成的协议，是对劳动关系双方权利义务的调整和重新安排，涉及到用人单位和劳动者之间的博弈，即是用人单位限制劳动者择业自由权的体现，也是劳动者合法权益得到尊重和保护的体现。因此，科学、合理的服务期制度不仅可以鼓励用人单位对劳动者进行人力资本投资，也有利于劳动关系的和谐稳定。在《劳动合同法》制定之前，地方立法对服务期制度进行了广泛的尝试，且设置多有不同，取得了一些效果，也产生了较多问题。《劳动合同法》首次作为全国性立法对服务期制度进行了明确和规范。但受到传统社会法理念的限制，《劳动合同法》既想发挥服务期制度的功能和优势，又想充分保护劳动者的择业自由...; Although not included in an employment contract, the term of service, reached by an employer and a employee through equal consultation, is new arrangements and adjustments of rights and obligations in employment relationship.
