| 英文摘要 | 前科制度是通过限制或剥夺犯过罪的人刑罚执行完毕后的一定资格和权利，实现预防犯罪、防卫社会的目的。它的理论根据是报应和预防的内在统一。前科消灭和出狱人保护是前科制度两个重要的要素。 在我国司法实践中，虽无明确、完整的前科制度，但在法律规定中却不乏对有前科者的义务性、禁止性规定，由此导致前科后遗效应广泛存在于我国社会生活的各个方面，给犯过罪的人顺利回归社会、改过自新设置了巨大的制度障碍。没有前科消灭的规定，对有前科者只有权利限制没有保护措施，前科制度实际上成为对犯罪人进行第二次惩罚的工具，其预防再犯罪的功能反而被弱化了。 作者将本文分为三章，对前科制度及其在当下中国的实践进行了较为深入的探讨。...; The aim of crime record is to anticrime and protect the society by limiting ordepriving of the criminal's certain qualification and right to some extent after the punishment.
