| 英文摘要 | 随着人们生活水平的提高，对住房的质量要求也越来越高，对所在租赁房屋进行相应的装饰装修业已成为普遍现象。装饰装修物和房屋的结合有不同状态，本文只是探讨租赁房屋装饰装修物与租赁房屋不能或不可分离情形下所涉及的法律问题，其实质是附合制度在现实生活的体现。与其他国家通常采取不当得利请求权不同的是，我国最高人民法院2009年出台的《关于审理城镇房屋租赁合同纠纷案件的司法解释》（以下简称《房屋租赁司法解释》）11号文件中，第9—14条的处理思路“未见不当得利制度的踪影反倒遍布损害赔偿的规则，个别地方则为风险负担，与不当得利制度相去甚远，同样充满着损害赔偿的思想。”我国究竟应采取何种权利救济方式，本文将在对...; The development on the level of the living has led to the high needing of the decoration in the rental house in our daily life.
