| 英文摘要 | 防卫过当是防卫制度中的重要内容，防卫过当的认定也是司法实践中的难题之一。而防卫过当的罪过问题是其中争议最多、分歧最大的一个问题，理论界和司法界对防卫过当的认定更是异见纷呈。基于此，本文对防卫过当的罪过问题进行了研究论证。 第一章是对防卫过当概念、特征和立法规定的介绍。第一节评析了学界关于防卫过当的概念的观点，认为防卫过当就是明显超过必要限度造成重大损害应当负刑事责任的行为。并通过防卫过当与正当防卫、一般犯罪的对比，明确了防卫过当的特征，从而将防卫过当行为和正当防卫行为及一般犯罪行为区别开来；第二节介绍了国内外刑法关于防卫过当的立法规定，并分析了对防卫过当“减轻或者免除刑罚”的依据。 第二章...; In the defense system, excessive defense is extremely important.
