| 英文摘要 | 在跨国民事诉讼法的协调或统一化运动中，由美国法学会与国际统一私法协会合作主持的“跨国民事诉讼原则与跨国民事诉讼规则”项目（以下简称“项目”或“跨国民事诉讼原则与规则项目”）异军突起，已取得了一定的成效。项目的宗旨在于努力为跨国商事诉讼提供一个公平处理的程序平台，降低当事人在域外诉讼中，因不熟悉他国诉讼程序而需承担的诉讼过程与结果不确定性的风险，从而促进跨国商事交易的发展。鉴于目前国内学者对项目及其成果的研究较少，本文首先介绍了该项目的背景及成果，并在此基础上分析项目可能遇到的困境以及项目成功的可能性，进而阐述项目对我国的启示及意义。本文除引言和结语外，分为四章。 第一章首先对诉讼法协调或统一...; In the movement of harmonization or unification of transnational civil procedure law, “Principles and Rules of Transnational Civil Procedure”, a joint project held by the American Law Institute (ALI) and the International Institute for the Unification of Private Law (UNIDROIT）has achieved success to some degree.
