| 英文摘要 | 利益平衡是一种重要的法律价值，在这种法律精神的指导下，著作权法追求著作权人和公众的利益平衡是必要的，私人复制正是这种平衡机制下的成果。法律赋予公众这种权利，可以在一定条件下复制享有著作权权利的作品。这个“一定条件下”的规定各国并不完全一致，也即对合理性的标准定位不同。随着科学技术的发展，网络的普及以及数字化技术的广泛运用，传统著作权法的复制概念的内涵需要延伸，私人复制这一行为在网络时代下也应该得到很好的规范。本文基于对私人复制合理性的分析，针对网络新环境下作品通过网络被大量的上载、下载以及任意复制的情形，指明在网络环境下私人复制行为应该受到限制。我国可以借鉴国外成功的法律制度来限制网络环境下的...; Balance of interests is an important legal value.
