| 英文摘要 | 在历史演进过程中，作为英美证据法核心和灵魂的传闻证据规则逐渐被大陆法系部分国家和地区所移植或者借鉴。随着相关制度不断发展变化，此规则所具有的超越法系之价值愈发彰显。本文试图以理论研究、比较研究、实证研究为基石，从宏观角度对现代国家及其他地区的传闻证据规则之沿革和趋势进行深入研究与剖析。同时，本着尊重法律文化之历史继承性和地域发展性的原则，结合探析现代传闻证据规则变革之成果，获得与我国司法改革理想目标相关的有益启示。围绕该目标，本文除导言和余论外，共分四章展开。第一章主要介绍传闻证据规则历史演进的脉络。第二章主要介绍传闻证据规则的新趋势。第三章主要介绍传闻证据规则与直接言词原则之异同。第四章主要...; In the historical evolution, hearsay rule, as the core and soul of Anglo-American Evidence, has been transplanted or absorbed gradually by some civil law countries and regions.
