| 英文摘要 | 利他合同存在债权人、债务人和第三人三方利害关系人。由于合同相对性原则的存在，第三人的法律地位被相对弱化，其权利义务较为模糊，在合同无效、被撤销、被解除以及合同当事人违约等情况下，第三人权益更难以得到救济。我国立法对此问题的规制模糊不清，故此，理论界纷争不断，实践操作困扰丛生，实有必要再加以研究和明确。 本文以第三人利益为中心，采用历史研究、比较研究、法解释学等研究方法，对利他合同第三人的利益成立、权利义务、利益保护等问题作了一番分析和思考，试图从中得到一些启发，进而对我国立法体制进行评价，并在借鉴别国制度设计的前提下，结合我国立法现状提出个人建议。 本文共分成四章： 第一章论述了利他合同...; Promisor, promisee and third party beneficiary are relative with the contract for the benefit of third party.
