英文摘要	1997年3月14日修订的《中华人民共和国刑法》对单位犯罪做了规定，为依法惩治单位犯罪提供了法律依据。但是该《刑法》对单位犯罪的规定过于简单、抽象，无法解决相关具体问题，包括：到底什么是单位犯罪？单位如何实施犯罪？单位犯罪中直接负责的主管人员和其他直接责任人员是否是单位犯罪主体、为何承担刑事责任、如何承担刑事责任？等等。这种情况的存在，造成刑法理论上和司法实践中对单位犯罪的许多具体问题的理解还存在分歧。分歧的存在又不可避免地影响了法律的贯彻执行。随着打击单位犯罪工作的进一步开展，如何准确追究单位犯罪直接负责的主管人员和其他直接责任人员的刑事责任，做到罪、刑、责相适应，达到预防犯罪的目的，是摆在...; The Criminal Law of the People’s Republic of China revised on March 14,1997 prescribes a unit crime, which provides legal grounds to investigate the criminal responsibility of a unit committed a crime.
