英文摘要	保护和开发非物质文化遗产是国家知识产权战略的主要内容，“铜梁火龙”的商标注册开辟了商标权的保护模式，商标权保护模式是指将非物质文化遗产作为商品或服务，通过商标注册而获得保护的方式。商标权保护非物质文化遗产是一种立足开发的保护模式，采用商标法对非物质文化遗产进行保护是将其纳入知识产权领域的主要选择模式。 本文从以下几部分对非物质文化遗产的商标权保护相关问题进行论述：首先，对比分析联合国教科文组织《保护非物质文化遗产公约》与我国颁布的《非物质文化遗产法》中关于非物质文化遗产概念的界定，在此基础上，对非物质文化遗产的概念和范围进行界定并对其特征进行概括，论述我国非物质文化遗产私权保护的必要性和可行...; Protection and development of intangible cultural heritage is the main content of the National Intellectual Property Strategy, “Tongliang Huozhu” trademark registration has opened up a mode of protection of trademark rights.
