英文摘要	本文以世界控烟趋势为背景，以行政法的行政规制为视角，试图从行政规制主体和行政规制方式两个角度来研究中国的控烟问题。 本文除引言和结语外，共分为四部分。 第一部分从世界控烟的历史出发，叙述了世界控烟的历史缘由，着重介绍了美国和中国的控烟历史，接着从中国国情出发，分析了中国意义上的控烟的概念。然后阐述了政府控烟的必要性和可行性，最后以控烟是政府的职责着手，阐述了控烟与法律之间的关系。 第二部分首先阐述控烟行政规制的必要性和可行性，然后从“内部控烟”的角度，分析了中国目前控烟行政规制的形式，从“外部控烟”的角度，分析了目前中国控烟行政规制的方式，最后分析了目前中国存在的控烟规制主体模式。...; This article is based on the background of the trend of world smoking control with the view of administrative rules and regulations of administrative law.
