| 英文摘要 | 我国法律对于气象预报的法律属性没有明确规定，理论上存在四种观点：第一种观点主张气象预报属于《著作权法》保护的作品；第二种观点认为向社会大众提供的气象预报属于公共产品，专业气象预报则不具有公共产品的属性，属于特殊的知识产权；第三种观点认为气象预报是一种科技成果，制作和发布人对其享有所有权；第四种观点主张气象预报信息不受著作权法保护。法律属性的不明确导致关于气象预报传播权的争议很大。实践中，擅自传播气象预报的行为时有发生；这些传播行为是否构成侵权、侵犯的是何种权利等也引起很大纠纷。因此，论证气象预报的法律属性并探讨其传播权具有积极的理论和现实意义，有利于气象预报更好地为经济建设、国防建设、社会发展...; The legal property of weather forecasting in our law is not clear, and there are four views in Theory.
