| 英文摘要 | 医疗科技的高速发展，使得人们可以通过检测得知胎儿的健康状况。近年来，由于我国医疗机构工作人员的过错导致检测结果错误引发的损害赔偿案件频发。本文试借鉴美国侵权法上wrongfulbirth的概念，针对这一类型案件，探讨其相关损害赔偿责任，试对此类案件的争议解决进行自己的思考。 本文共分为四章。 第一章主要对不当出生的基础理论，包括基本概念、起源及发展、不当出生的比较法状况等进行论述。 第二章则对是损害赔偿责任认定中的几个争议问题进行探讨。不当出生存在着两种可能的请求权基础，就违约责任和侵权责任，本文认为选择侵权责任更利于原告。以侵权责任诉讼中最大的争议问题是不当出生中侵害的是原告的何种权利...; The rapid development of medical technology makes it possible to get to know the health condition of the fetus by examinations.
