| 英文摘要 | 再制造是一项利用先进技术使废旧产品恢复性能甚至提高性能的工程。在资源逐渐短缺、环境不断恶化的今天，再制造对节约资源、保护环境乃至社会的可持续发展都有着重要的意义。然而，无论再制造的意义如何重大，都必须遵守现行法律的规定，不得作为侵犯专利权人的权利的理由。 本文以产品再制造中的专利问题为研究对象，从理论和实务两方面进行讨论。 第一章主要从再制造工程学上的涵义入手，通过分析产品再制造的流程，归纳了其在《专利法》上产生的争议焦点，讨论再制造侵犯了专利权人享有的“制造”这一专利权的核心权能的判定原则。 第二章理论分析论证再制造的合法性。运用“权利用尽理论”、“默示许可理论”和“利益平衡原理”等《...; Remanufacturing is an engineering project which use advanced technology to recover performance or even improve the performance of wasted products.
