英文摘要	近年来，由于我国现阶段医疗体制和医疗法制的不完善，医方在医疗过程中未尽说明义务，损害患者知情权和合法权益的现象屡有发生，而患者的维权意识却在不断增强，从而导致我国医患纠纷愈演愈烈，因此探讨患者知情权问题尤有必要。本文主要对美、英等西方发达国家有关患者知情同意权方面的立法、司法实践进行介绍和粗略研究，以期为我国相关领域立法的完善提供有益借鉴。 本文除前言和结束语外，主文共分为四章。 第一章“英美法上患者知情同意权的产生与发展”介绍了知情同意权的历史沿革，以及美国法上和英国法上的患者知情同意权的渊源，并阐述了患者知情同意权的内涵。 第二章“英美法上医方的说明义务”主要从说明义务的主体、内容、...; In recent years , the present medical treatment system and medical legal system in our country are still to be improved , and the physician’s duty to disclose information is usually not properly fulfilled , thus the patient’s lawful rights and interests , including his right to consent is often tampered .
