| 英文摘要 | 占有制度是物权法中极为重要的制度之一。随着社会经济的发展，当事实上的支配关系被法律抽象成为观念上的占有，占有被“法律化”和“观念化”，间接占有制度随之有了生存与发展的空间。直接占有和间接占有的区分，最终在1896年《德国民法典》中以法条的形式予以确立，并成为建构占有制度的方式之一种。间接占有制度在我国民法中是否有生存的空间，对于这个问题，学界始终没有达成一致的看法。要想回答这一问题，对于间接占有制度的深入研究必不可少。鉴于此，本文通过历史研究、比较法研究等方法，试图证明间接占有制度确有其他制度所无法替代的功能和作用。 本文第一章首先阐述了间接占有制度在我国的立法以及学术研究的概况，并运用历史...; Possession is one of the most important systems in Property Law.
