| 英文摘要 | 内容摘要著作权强制许可制度并不是一项新的法律制度，但它却是当前最富有争议性的法律制度之一。本文在借鉴各国立法和国际公约规定的基础上，通过分析强制许可的立法目标和法的功能，认为该项制度在众多著作权限制制度中具有独特的、不可替代的作用。在结合我国的实际情况，笔者认为强制许可作为著作权限制制度中的重要组成部分，应引入我国的著作权法。本文就是围绕此基础展开讨论的。第一章为著作权强制许可基本内涵分析。首先介绍著作权强制许可的描述性定义，其次从具体的制度上和许可使用、法定许可使用、合理使用等制度进行比较，最后论述其法律属性——介入著作权领域的行政权及其法律特征。从描述上和学理上两方面完整地把握著作权强制许...; ABSTRACT The Compulsory License System of Copyright (was called the System hereinafter) is not a new creation.
